If nothing else, I’ll do my best to give unbiased updates when writing about West Easton Council Candidate Tricia Mezzacappa. Since I previously wrote of her criminal case in which she was charged with defrauding a secured creditor, it is only fair I report the outcome of that case.
To make it clear, I did not attend any hearings. I’m simply repeating some of what was written by local political blogger, Bernie O’Hare, who happens to be the secured creditor in that criminal case Mezzacappa found herself as the defendent.
It appears Mezzacappa’s publicly appointed defense attorney found a technicality to have the case dismissed. That technicality being the failure to issue a new writ of execution after 90 days had elapsed from the first one being issued.
According to O’Hare, “Ordinarily, a writ of execution expires unless it is served within 90 days. But Eric Rothrock, a Real Estate Deputy for the Sheriff’s Department, testified that the practice in that office is that once it is served upon a Defendant or a bank, as happened here, the writ continues in effect until the judgment is satisfied. Though the Court agreed that the writ continues in effect as to those banks, it needed to be reissued for Mezzacappa.
The Court agreed that there was ample evidence that Mezzacappa intentionally concealed the property, but the writ was no longer valid.”
