West Easton Council Authorizes Solicitor To Recoup Funds From Former Council President, Others

Three separate motions were made during last night’s Council Meeting to recoup funds for the Borough of West Easton. All passed unanimously (5-0, Louis Niko and Tom Nodoline absent).

Two of the motions named former Council President Kelly Gross directly.

The first motion had to do with a letter dated December 28th, 2015, sent by Kelly Gross to residents. Our solicitor provided his opinion that it was not a Borough newsletter, but rather, a personal letter.

Motion #1: Authorizing the Solicitor to forward correspondence and take all necessary steps to recover the amount of Borough funds spent when Kelly Gross wrote a letter to Borough residents for her personal benefit utilizing public resources.

The second motion referenced a check Kelly Gross had received, claiming she was the Emergency Management Coordinator, but upon further investigation it was determined that she did not hold that position.

Motion #2: Authorizing the Solicitor to forward correspondence and to take all necessary steps to recover the amount that Kelly Gross received as Emergency Management Coordinator when she was not Emergency Management Coordinator.

The third motion did not publicly name any persons involved in our Computergate episode, but came following my notification to Council that I had, as a private citizen, submitted an RTKL request for copies of security camera footage that showed the individuals responsible for the computers leaving Borough Hall. If no legal matter was pending, then it was likely the recordings would have to be supplied.

Motion #3: Authorizing the Solicitor to forward correspondence and take all necessary steps to determine the costs involved and the harm to the Borough and to recoup these funds from any responsible parties participating in the computer removals.

Responding to Mayor Gross’ question to me of what costs were involved, I mentioned only a couple. Replacement of equipment and the need to pay a new IT person for the time he put in correcting problems.
