Constable Tricia Mezzacappa Fears Her Vexatious Requester Days Numbered

Tricia Mezzacappa, AKA Tricia Phillips, sees a problem headed her way. It’s not the charge of making a false report to the PSP. She is confident that will never get past the Preliminary Hearing.

It’s a possible Vexatious Requester Law that will apply the brakes to her blizzard of Right To Know requests she has been submitting to the borough of West Easton.

The West Easton Vexatious Requester Resolution No. 2019-016 was one I drafted. It was approved by Council. Nearly 100 other municipalities in Pennsylvania joined with their own resolution, before the Pennsylvania State Association of Boroughs (PSAB) adopted it. Pennsylvania State Association of Township Supervisors (PSATS) has also taken up the banner of addressing a vexatious requester in townships.

Mezzacappa’s original scoffing and ridicule of the Resolution has now turned to fear of a law that will impede her abuse of the Right To Know Law (RTKL).

When a total of 2500 combined communities is seeking a law that would provide relief from a vexatious requester like Mezzacappa, she is concerned that she will be seen as the catalyst that required fixing a problem with the current law.

Her cohorts in western PA must be thrilled they took her into their fold, for if they are legitimate in the quest for transparency to improve government, they found a comrade who doesn’t care about better government and the public good – only herself.

They are undoubtedly looking at some of her RTKs and thinking, What in Hell is wrong with her? This is a personal dispute and has nothing to do with the public good.

They can thank Tricia Mezzacappa for me taking a closer look at what other communities are experiencing and organizing them to solicit relief.

State legislators don’t care when one public agency seeks a venue for relief, but when 2500 want action taken on the same problem, they are going to provide a venue.

Mezzacappa is desperately hoping to turn back what she once considered a ripple, but has become a tsunami. She realizes the Resolution is headed to Harrisburg and if there is a Vexatious Requester Law added to the books, she will be the poster child for its approval by the PA Legislature. She won’t survive a review that a Vexatious Requester Law would provide to an agency.

Mezzacappa has sent a letter to PSAB in an attempt to justify all her requests, claiming a “secret bank account” was discovered by her, thanks to a RTK request she submitted. The letter was copied to Senator Lisa Boscola and Representative Robert Freeman.

Writing that letter tells me she is beside herself, as she sees a Vexatious Requester Law is on its way. It also tells me she will continue to lie and twist information to fit her square-peg-in-a-round-hole narrative.

She goes on to say that [Dees] had “access” to this supposedly secret account, which expended “thousands of dollars without any approval from Borough Council,” the cash balance was modified, and that it triggered a PA State Ethics Investigation.

She wrote and signed the letter as, “West Easton Borough Constable,” as if to give it some “authority.” There is much more to her usual cRaZiness, but lets start with the above.

She uncovered no “secret” account.

There is no PA State Ethics Investigation.

It’s more lies by our State Constable, already facing that charge of filing a false report with Pennsylvania State Police.

Nobody was running a secret account, and auditors were well aware of the account’s existence.

The account is a debit card account that was created by Council in 2016. It is for the Borough office to use for needed purchases, with an allotment of up to $800/mo., so that they didn’t have to wait for the next Council meeting to purchase replacement equipment, or needed supplies.

There was a lapse in debit card purchases being submitted to Council for approval at the end of each month. Nothing major. Not even close to the $800/mo. allowed to the office. When it was discovered the purchases didn’t get Council approval at the following meetings, all were submitted, reviewed, approved by Council and added to the office expense account. No cash balances were modified.

With all the RTK’s our Borough Manager has to deal with, a procedure is bound to slip through the cracks occasionally. It was found and corrected. The review procedure of debit purchases was desired by Council. It wasn’t required by any law.

I do not have access to the debit card, but if needed, can sign for payments to fund the debit card that carries a $2500 limit. I am assigned as a signatory on all checks the Borough needs signed, including payroll and vendor payments. It is seldom I am called to actually sign checks, as other approved signers are usually available for the required second signature on checks.

She then goes on to say, “the debit card to the account had to be cancelled (sic), purchases refunded for website name/hosting fees paid to hostgator (sic) and name cheap (sic), and a new card issued by the bank.” Just to make the insinuation complete, she was sure to note, “Mr. Matthew Dees… also uses uses hostgator (sic) and name cheap (sic) for his web hosting vendors.”

At least she didn’t claim I own Hostgator, as she did in one of her more moronic claims she made in the past.

A refund was made on a debit charge – not by West Easton, but by the bank, because Hostgator billed West Easton incorrectly. One debit card was canceled by our Borough Manager – not the bank – and the cancellation was done to ensure when the automatic billing by Hostgator comes around again the debit card originally used would not be charged incorrectly a second time. Only one card is currently available for use at Borough Hall.

All of this was, of course, explained to Mezzacappa, but she will write what she wants, to twist anything in a way that justifies her false accusations.

Most of her letter is, as always, her blaming me for her problems and trying to justify her unrelenting requests to my employer for information on me, and the more than 120 RTK requests she has submitted to the Borough since the beginning of this year. There is little in her letter that actually relates to the Vexatious Requester Resolution. It’s about her personal grievances and me.

It seems she doesn’t like the Borough listing RTKL requests on their website, though she claims transparency is something she wants. Apparently, transparency is good thing, unless it is evidence of her abusing the RTKL, or personally involves her.

She misrepresents my encounter with a young woman arrested for assault at a local Walmart and who I ultimately assisted in qualifying for county drug treatment (she is now well into dependence recovery, last I heard). Mezzacappa, ever vindictive and trying to interfere with an investigation, went so far as to contact Colonial Regional Police Dept. (CRPD) and wrote that she believed I assaulted the young woman. Thankfully, witnesses were present at the time.

CRPD followed up on her letter. I got a phone call telling me there was a “resident” of West Easton that sent them an email, who they suspected of having “mental issues.” They didn’t consider her dangerous, but I was being made aware that I was her target. I knew exactly who they were talking about. I now possess a copy of what she sent them.

Mezzacappa always plays the victim. Woe is me. Dees is being mean to me. Just look at his website!

If I didn’t have to point out her stupidity and lies in what she writes, or if she could stay out of trouble, I would prefer not mentioning her, but she is a “State Constable” subject to public scrutiny (and RTKL), and actually seems to enjoy conflict.

For almost a year I wrote nothing about her, while she continued with her childish attacks on her official Constable Facebook page.

Yep. She’s showing me. People see an unemployed and aged woman, a State Constable to boot, with the mental maturity of a 12 year-old, giving the Council the middle finger, calling the Northampton County DA a “dick eating asshole,” or posting debt judgments about individuals who she feels slighted her. Odd how she fails to mention her own lien for unpaid school taxes, or discloses how she is provided healthcare.

In her rambling letter to the PSAB she states, [Dees] “posted a document that accused my mother of heinous acts she did not commit.” I’m not sure what “heinous acts” Mezzacappa is referring to, and I don’t want to know. I only know of one simple court document.

I linked to a public court document in my post about Mezzacappa and local blogger Bernie O’Hare, in which her mother got dragged into a lawsuit because Tricia Mezzacappa’s home was transferred to her mother, to avoid it being part of a $67,000 judgment against Mezzacappa for defamation.

Mezzacappa, as usual, feels compelled to play the Drama Queen. She made claims in a courtroom that my “publishing” the public document caused her family great distress and has interfered with the settlement of her mother’s estate. My opinion is it’s more likely her sister, a real attorney and the executor of the estate, has discovered all the money that mom gave Mezzacappa over the years and seeks an altered distribution of assets.

The rest of her letter is the typical, “blah, blah, blah” from Mezzacappa. She says I insulted the memory of her dead pig, I yell at her and residents at meetings, I hate the residents of West Easton, performing my job of Councilman, and revealing public information. She’s jealous I have a full-time job, benefits, and am paid a decent wage.

Her complaints are actually mild in comparison to her past lies.

I’ve been accused of hacking her computer, attempting to send her a computer virus, owning a porn website, infecting borough computers with malware, being dishonorably discharged, owning a $250 million company (Hostgator), making money when people click on the borough website, driving on the sidewalks, a danger to children, stealing a picture of her dead pig, stalking her, breaking PA auctioneer laws, being gay (or, to quote Mezzacappa, a “faggot”), and stealing a borough toilet, to name only a few of the many, many chunks of poo she has slung at the wall, in the hope that something would stick.

I’m surprised she hasn’t accused me of bagging up puppies and taking them down to the river.

Her latest foray into the bizarre on her FB page is that her Malwarebytes program has identified and quarantined something delivered by this website.

Having seen her “evidence,” I can’t wait for when she follows through on her promise to deliver it to the authorities. I’m sure they’ll be looking for her tin foil hat.

As I was saying, and what she said herself in the letter, nothing is ever her fault. She continues to play the victim and concludes her letter with a desire to testify, should a vexatious requester law come to the House Floor for a vote.

That is something I’d like to have happen, as well.

It would give them a peek into the mind of Tricia Mezzacappa and definitely speed up the process of getting a vexatious requester law on the books.

Luckily, Mezzacappa’s reputation and lack of credibility precedes her. I am sure Mr. Freeman and Ms. Boscola are now familiar with West Easton’s common scold and her past history, including that pending charge of filing a false report with the PSP.
