Constable Mezzacappa Takes Offense

2As I previously noted about Constable Mezzacappa’s temperament, she has taken umbrage with my last post regarding her issuing warnings in the borough. Clarifying her duties as a Constable, using a Constable owned website as a reference, and to assure residents she is not being paid with municipal funds, seems to have raised an anger issue from her once again.

I received the following email from her. I have made some of my own comments in certain sections to answer her confusion on some matters she felt the need to address:

Dear Mr. Dees,

I have noticed you have posted a warning from me on your blog. You do not have my permission to post anything on your blog relating to any of my Constable activities. They are not records of the Borough and are exempt under the PA RTK law from public disclosure.

The notice was not delivered to the party she issued the warning to. It was left in full public view on the windshield of the car. She made it public, not I.

Secondly, you are once again misinformed, and have not attempted to find facts before posting your blogs, nor have you contacted me prior to posting.

Bob Lewis asked me to warn a vehicle that hasn’t been moved in several months , parked in the area of his home.

I am not required to contact Mezzacappa and I made no mention of how she came about issuing the warning, though if she did issue the warning on another’s request then she did not witness the violation herself. Further, if Councilman Bob Lewis made such a request, it was of his own volition and not that of the West Easton Council.

If Council is unhappy that I am performing a free service to enforce local ordinances of this Borough, as I have powers to do under state law, then West Easton can repeal its ordinances and there will be nothing for me to enforce. I refuse to enforce unconstitutional ordinances. I am aware West Easton has a few of these.

With winter just around the corner, I thought this Borough would be happy that I am taking my own time, without compensation,  to warn people who do not follow parking / noise ordinances. When snow storms hit, this has a negative effect on Borough Streets.

I did not mention any happiness or unhappiness of the Council. The piece written was to make it clear that she is not under the direction of West Easton Council, as people assumed she was. I also mentioned in my piece that she has not asked for compensation.

It is clear from your antics, and in retaliation from the embarrassing deposition you sat for in August of this year,  that you have no regard for laws and safety of the residents. However, I have lived here for 18 years and do wish to serve the members of the community who elected me. That includes all residents, elected or not. Since there is no Police Department that will touch West Easton Borough with a ten foot pole, and the overburdened State Police do not respond for local issues, I am doing what I can within statute to make sure that our residents have a person to go to with complaints that are not covered by State Police.

When I receive a complaint from a resident, as I have in the last few months, I will continue to serve in the capacity I have, as a result of the election.

Since she is aware that her lawsuit against our borough is in litigation I am unable to state exactly what occurred during my deposition. I will only state that the embarrassment was on a Pro Se plaintiff who lacked skills in submitting proper questioning. I have no need to retaliate to failure.
As to local police, residents know who helped contribute to the loss of Easton Police coverage and her letter to Wilson Borough urging them not to contract with West Easton only further undermined past efforts. Something I chose not to mention in my original piece.

Your obvious bias and childishness as an elected official in this Borough is troublesome. Maybe you should follow Bob to some of his educational seminars , so that you can function as an informed Councilman who serves the public.

I will reply that something is certainly obvious about a Constable who sees criticism in a piece that informs residents Mezzacappa is independent of the Council. A point she makes herself in this letter to me, but takes offense that I wrote about it?

Tantrums aren’t befitting a State Constable.
